Correct me if I am wrong too but DA is a MIND EFFECTING SPELL according to the game engine.....so a simple Protection from Evil or Good would work. Since we allow the opposite side of RP for assassin here without actually implementing the avenger class. We really should change the class to stealth expert or something...the feat call it paralyzing strike instead. That fits RP of all levels for the class.....but that is off topic I guess.

yes it is, however it is because paralysis itself is mind affecting, that part actually has nothing to do with death attack
if we were to allow death attack to function without being hindered by a first level spell, we would have to add the other option to death attack, being the save or die
then its a death effect and all the mind protection spells wont stop it, but death ward would (properly)

I've recently been playing a halfling crossbow sniper that utilizes this mechanic, its a crazy fun build to play but also very much a glass cannon and one that suffers heavily due to the penalty from Many shot to AB, it hits as much as -8. ontop of that having Epic dodge or deflect arrows in theory would also totally negate it.

Something to note. Once you are paralyzed, they can kill you all but instantly because you will lose all of your bonuses to AC against all attacks.
So even with a duration of one round per level of assassin or something very, very short you will still likely not survive the effect.
Personal Note:
I for one do not like the idea of adding more save or die effects to the game and the duration on this effect is needlessly long. Perhaps some number of rounds per assassin perhaps?

Why that? The fact that the target is paralysed - even for a long time - is a nerf. What should happen is:

Death Attack
If an assassin studies his victim for 3 rounds and then makes a sneak attack with a melee weapon that successfully deals damage, the sneak attack has the additional effect of possibly either paralyzing or killing the target (assassin’s choice). While studying the victim, the assassin can undertake other actions so long as his attention stays focused on the target and the target does not detect the assassin or recognize the assassin as an enemy.
If the victim of such an attack fails a Fortitude save (DC 10 + the assassin’s class level + the assassin’s Int modifier) against the kill effect, she dies. If the saving throw fails against the paralysis effect, the victim is rendered helpless and unable to act for 1d6 rounds plus 1 round per level of the assassin. If the victim’s saving throw succeeds, the attack is just a normal sneak attack. Once the assassin has completed the 3 rounds of study, he must make the death attack within the next 3 rounds.
