Yes well you still have the legal issues like mentioned previously. Unless DnD 3.5 (or overall DnD) will be released as free you can do squack.I do not like the new DnD 5.0 system. Feels to much mmo like.

Unless one would create a system from scratch (doubt it).

I voted unsure since it is highly unlikely for you to get a license to create a game based on D&D without it being 5th edition.

I've had one issued from a company that may or may not now be owned by a bigger company that may or may not have several theme parks which may or may not have a mascot that may or may not resemble a rodent.

Intellectual property infringement can cost tremendously.
