Dodgy goings on in the Auction House

No names named in public, but I bought an item in the auction house that turned out to have an enchantment on it of a purely temporary nature. I'd like my gold back. I did by chance find the player responsible, but they were not responsive.

Was it done IC?
I see no problems, unless it was done purely OOCly? That's being robed, no?

Report him/her to the flaming fist and get them hanged. Molten gold works too.

TBH, I have looted items from enemies with long term weapon buffs on them that I thought were legit items for several days. Maybe this was the case? I can't remember off the top of my head exactly what it was, but it was a good base item with a useful massive crit and +3 EB, but it turns out the mob had used GMW, and the +3 went away by the next time i looked at it (several days later).
Not sure if the mobs cast GMW, or it also spawned with an item that let him use it? IDK, but I would wager the "unresponsiveness" of the other player sort of removes the doubt of the shady dealings.

In this case I don't see why you should not out them, if they don't respond in 3-4 weeks IF it was OOC.

It's the auction house. IMO that's OOC; you want IC you do it in the forums.

I recall something similar from 5 to 6 years ago and I think it's illegal to sell items like that in the first place.

the "IMO" counts as much as "IMO, All is IC"

DM ruling needed.

Actually I don't remember even one enemy casting GWM. They do spam flameweapon, though. But not GMW.

Buyer beware, thieves and con artists lurk around every corner.

IC that's fine. The Auction house is not IC though.

If it were IC, the items would lose their effectiveness after a time anyways. On top of that, wouldn't the consignment guy know not to take false items? Yeah. I don't see how this could be IC.

The issue comes down to;
If we allow this, then it opens it up to EVERYBODY else to scam and people will start doing it. It doesn't take character skills into effect. How do we know the PC doesn't have a Detect Magic or casts Identify when purchasing a magical object? We don't, which is why the money should be returned and a rule announced that it's illegal.

A similar thing happened to Lelande once. So I showed the DMs the original auction forum post (which advertised a +4 EB weapon), and showed them a screenshot of the weapon without +4 EB. The DMs ended up taking the weapon and giving me a gold refund. I don't know what/if they did anything to the other player. I also don't know if this is now the "official" policy. But I agree with Flasmix's points above.

Heh, as an old Eveonline player I noticed these items on the AH a while back and just smiled and shrugged, some are quite easy to spot (same double enchantment etc). I've also noticed the 'Perfected Alchemist Fire' on the AH which were the 2d6 ones.
However in hindsight none of these temp enchantment items should appear in the AH as Mudd's reputation is on the line. If he allows dodgy items then its his name dragged through the dirt, so I'd expect him to verify all lots and assume has the means to do so. Afterall he has a substantial genuine business, why risk it for a couple of dodgy lots?
Add the above points also about the buyer checking the lot and yeah, the AH has to be considered OOC as none of this can be represented IG.
If it is IC though, given its all recorded by Mudd I guess that means the seller/conman being given 'criminal' status by the guards (Arrest / KoS? / Incarceration) if reported.
